HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.14973 of 2010 ORDER :

Heard Mr.Palle Nageswar Rao for petitioner and Mr. A.Venkata Ramaiah for respondents.

The grievance of petitioner is against disconnection of power supply to S.C.No.SNC 7372, Category-II, Srinagar Colony, Godavarikhani, Karimnagar District purportedly pursuant to notice dated 28.01.2010, without determining the civil liability under Section 151 (5) of Electricity Act, 2003, as illegal, arbitrary and unconstitutional.

On 29.06.2010, the following interim order was passed: "There shall be interim direction to the respondents to restore the supply to the petitioner theatre bearing S.C.No. SNC 7372, Category-II subject to the petitioner depositing half of the provisionally assessed amount and also the restoration charges, if any." Learned counsel appearing for the parties do not have instructions in the matter, much less, latest position on the subject service connection. Having regard to above circumstances, more particularly the interim order dated 29.06.2010, this Court is of the view that the interim order can be made final order and it is needless to observe that if the respondents are entitled to and intend to pass final order, the respondents are free to do so subject to issuing notice to petitioner and after affording opportunity.

With the above observations, the writ petition is disposed of. No order as to costs.

As a sequel, pending miscellaneous applications, if any, shall stand closed.
