O R D E R

The case of the petitioner is that she filed an appeal under Section 90 of the A.P. (Telangana Area) Tenancy and Agricultural Lands Act, 1950 to the 2nd respondent - Joint Collector, against the order passed by the Tahsildar in file No.B/ 2259/ 2005 dated 24.02.2007. The same has been returned by memo of the 2nd respondent dated 3.6.2016 raising certain objections. The petitioner represented the appeal by complying with the said objections. Again by memo dated 9.8.2016 the appeal was returned on the ground that no delay condone petition has been filed, as the appeal is filed after more than nine years of passing of the order dated 24.2.2007. The grievance of the petitioner is that though the appeal has been resubmitted on 10.09.2016 along with a petition to condone the delay, till date the same has not been disposed of. Hence the writ petition. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

Having regard to the facts and circumstances and the submissions of the learned counsel, as the petitioner is stated to have resubmitted the appeal on 10.09.2016 along with condone delay petition, without expressing any opinion on merits, the writ petition is

disposed of at the stage of admission directing the 2nd respondent - Joint Collector to dispose of the delay condone petition filed by the petitioner in Tenancy Appeal No.F2/ 2190/ 2016 in accordance with law, if it is not already disposed of. To condone or not to condone the delay is discretion of the Joint Collector. No costs.
