HON'BLE SRI JUSTICE C.PRAVEEN KUMAR W.P. No. 34540 of 2018 ORDER:

The present writ petition came to be filed seeking the following relief:

" To declare the inaction of the Revenue Divisional Officer, Srikakulam, the 3rd respondent herein in disposing of the appeal dated 16.10.2017 or stay petition filed by the petitioner against the order Rc.No.104/ 2017A, dated 11.09.2017 passed by the Tahsildar, Polaki Mandal, Srikakulam district, the 4th respondent herein wherein and where under the record of rights are amended by incorporating the name of the 5th respondent herein in respect of an extent of Ac.3.595 cts. of land detailed in the said order situated in Jilleduvalasa village, Polaki Mandal, Srikakulam district as illegal, arbitrary, violative of principles of natural justice and unjust and set aside the order of the 4th respondent and consequently direct the respondents Nos.3 and 4 to restore entries existing as on 10.09.2017 in revenue records." 2.

The learned counsel for the petitioner mainly submits that though an appeal was filed by the petitioner on 16.10.2017, against the order dated 11.09.2017 passed by the Tahsildar, till date, no orders have been passed on the said appeal.

Learned Government Pleader would submit that if the appeal filed by the petitioner is still pending consideration, the authorities will dispose of the same within a period of three months. 4.

Having regard to the above, the writ petition is disposed of, directing the authorities to deal with the appeal filed by the petitioner on 16.10.2017 and pass orders in accordance with law, as early as possible, preferably, within a period of three to six months from the date of receipt of a copy of this order. As a sequel thereto, Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed.
