THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 20407 of 2011 ORDER:
This Writ Petition was filed alleging that the police authorities were colluding with the fourth respondent for unlawful gains and harassing the petitioner and her
husband.
Basing on the written instructions dated 05.06.2015 received from the Sub Inspector of Police, Parigi Police Station, Ananthapur District, the learned Assistant Government Pleader for Home stated that criminal cases were registered against the petitioner's husband in Crime Nos.55 of 2010 on the file of Sadlapalli Police Station and Crime No.69 of 2010 on the file of Penukonda Police Station. However, these cases were said to have been compromised thereafter. In the light of the aforestated facts, the police authorities cannot be interdicted from investigating any criminal offence and in the event the petitioner or her husband are involved in such offence, they would necessarily have to be summoned and examined. However, the police authorities are bound to follow the due procedure laid down by law while exercising such power. Making this clear, the Writ Petition is closed. Pending Miscellaneous Petitions shall also stand closed. No order as to costs.
