HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.10208 of 2018 ORDER:

The petitioner is accused No.4 among other accused of crime No. 72 of 2018 of Police Station, Boath, registered for the offence punishable under Section 498 A, 304 B r/ w 34 IPC. 2.

The marriage of the deceased with accused 1 was performed undisputedly on 18.04.2018. The deceased in in-laws house committed suicide on 11.08.2018 at 4.30 P.M., having consumed the pesticide poison at Kantagoan village and she died on the way to Government Hospital , Boath.

Report of the de facto complainant, none other than mother of the deceased speaks all the accused 1 to 5 harassed her daughter for additional dowry, even after meted the demand of dowry at the time of marriage, including from the promise by de facto complainant to pay Rs.1 lakh to their demand, by not satisfying with and it is averred that Accused 2 to 5 harassed at the instance of Accused 1 - husband also and several panchayaths have also held in this regard. 4.

The contention in the Anticipation Bail application of the petitioners is that he is working as a Village Revenue Officer / Public Servant and there is no basis but for balled allegations and falsely implicated ,if at all there is a case only against the accused 1 already in judicial custody and there is a case only accused -2 was granted anticipatory bail after arrest and thereby entitled to the concession of anticipatory bail.

The learned Public Prosecutor apposed the same saying that the petitioner among other accused all participated in the harassment in driving the deceased to commit suicide within the four months of the marriage that too in the in-laws house, making her life measurable and unbearable despite the assurance by the de facto complainant to meet further additional dowry of Rs. 1 lakh and even raised dispute through elderly for treating her well and thereby does not deserve for concession of anticipatory bail.

Heard and perused the FIR and dismissal of the anticipatory bail application of the petitioner in Criminal M.P.No. 920 of 2018 in Crime No. 72 of 2018 by learned Sessions Judge, Adilabad on 14.09 2018. If at all accused No.2 is granted the regular bail, if such liberty if at all the petitioner wants to avail is left open by surrender but for that there are no grounds to grant anticipatory bail.
