HON'BLE SRI JUSTICE S.V. BHATT W.P. No.17540 OF 2013 ORDER:

Petitioner prays for Mandamus declaring the orders of freezing of petitioner's Savings Bank Account No.24371530006260 of HDFC Bank as illegal and arbitrary.

The Assistant Government Pleader (Home) places on record the written instructions, which reads as follows " ... they puzzled a little at first and then disclosed that the first person is Mamidi Anil Kumar s/o.Tirupal, 27 years, Vysya by caste, r/o.D.No.24-154, Gandipeta, Chilakaluripeta, Guntur District. Now at Ganapavaram Village, Nadendla Mandal, Guntur District and the second person disclosed that he is Karaganti Madhu Babu @ Madhu S/o. late Brahmanandam, 27 years, SC Mala by caste, r/o. Thimmapuram, Yedlapadu Mandal, near Chilakaluripeta, Guntur District.

Both are stated that in the month of May and June,2012 they started threatening people on the name of Maoists and collected money from the rich persons by getting their phone numbers through online.

Recovered 1) Nokia-101 cell phone with SIM No.8142241653, 2) Bag containing Lenovo laptop and 3) Hero Honda Karizma motorcycle having yellow colour Regn.no.AP 16BB7676 i.e. crime vehicle, in possession of A-1, and 4) Nokia C-1-01 cell phone with no.8142057378, 5) Hero Honda CBZ Extreme motorcycle AP07-BP-9912 i.e. crime vehicle and 6) Black colour bag containing 1) 50 nos. of SIM Cards, 2) Two Data Cards,

3) 11 Nos. of cell phones, 4) 5 ATM Cards, 5) 2 Check Books in possession of A-2, identified the same as properties used by the accused A-1 & A-2 for committing offence in this case and other similar offences, seized the same under cover of mediators report dated 04.05.2013 in between 1100 hours and 1330 hours, duly attested by

mediators, wherein the accused noted supra admitted their guilt in this case.

Case was charged in on 10.-05.2013 vide CC No.451/2013, and case was acquitted 10-12-2015." In view of the above, no further order is necessary and the writ petition is dismissed.
