THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.39210 of 2013 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader appearing for respondent Nos.1 to 3. 2.

The prayer sought in the writ petition is as under:- "...to issue a Writ of Mandamus or any other appropriate writ or order or directions declaring that the action of the respondent No.3 in not taking any action agonist the unofficial respondents in spite of the complaints dated 05.09.2013, 25.11.2013 and 25.12.2013 and not registering any FIR and not taking any steps to prosecute the unofficial respondents under the provisions of the A.P. Land Grabbing (Prohibition) Act, 1982 is questioned in this Writ petition as being arbitrary, illegal and violative of Articles 14, 21 and 300A of the Constitution of India in respect of Plot No.B-16 and B-17, admeasuring 200 Sq. Yards each along with built up area of 6200 Sq. Ft.

having G+ 2 floors situated at Manikonda Jagir Village, Rajender Nagar Mandal, Ranga Reddy District, and consequently direct the official respondents to enquiry into the matter and take immediate action against the unofficial respondents as per law and provisions of the A.P.Land Grabbing (Prohibition) Act, 1982 and for trespass in respect of Plot No.B-16 and B-17, admeasuring 200 Sq. Yards each along with built up area of 6200 Sq. Ft. having G+ 2 floors situated at Manikonda Jagir Village, Rajendneragar Mandal, Ranga Reddy District, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned Government Pleader placed on record the written instructions, dated 20.09.2019, issued by the Sub-Inspector of Police, Raidurgam Police Station, Cyberabad Commissionerate. 4.

A perusal of the said instructions would reveal that the petitioner has not submitted any complaint, more particularly the complaints, dated 05.09.2013, 25.11.2013 and 25.12.2013, before the 3rd respondent-Station House Officer, Raidurgam Police Station. In fact, on verification of the station records, there are no such complaints lodged by the petitioner.

In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the writ petition is liable to be closed.

Accordingly, the writ petition is closed. However, it is open for the petitioner to lodge any complaint before the 3rd respondent-Station House Officer, Raidurgam Police Station directly in case of any necessity or police protection. On such complaint, the 3rd respondent is directed to take appropriate action.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
