HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5069 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/ accused Nos.1 to 8 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.57 of 2015 of Bhongir Police Station, Nalgonda District registered for the offences punishable under Sections 498-A IPC and Sections 3 and 4 of D.P Act.

2) Heard learned counsel for the petitioners/ accused Nos.1 to 8 and learned public prosecutor for 1st respondent-state before admission and before ordering any notice to de facto complainant-2nd respondent. Perused the material on record.

3) As the material falls short for this Court to admit the application filed under Section 482 Cr.P.C to quash the proceedings, the Criminal Petition is disposed of, with observation that they did not obtain bail that the investigation shall go on. The petitioners/ accused 2 to 8 shall not be arrested but they shall co-operate with police for conducting Investigation without any specific requirement by the Investigating Officer to attend. So far as the 1st petitioner/ accused No.1 concerned, he must surrender himself before the learned Magistrate concerned and move for regular bail with notice to Assistant Public Prosecutor concerned and in such event, the learned Magistrate shall grant bail on the same day or atleast by next day with

necessary conditions. It is needless to say after filing of any final report by police and taken cognizance by the Court, any further remedy is left open to petitioners.

4) Miscellaneous petitions, if any pending, shall stand closed.
