THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.4703 OF 2017 ORDER:

Petitioners' case is that they are landless poor persons and they approached the 4th respondent seeking allotment of house site plots at Baban Sahab Pahadi, and as per the instructions of the 4th respondent, petitioners erected tin shed houses in survey No.2200, Babandsahab Pahad Canal Katta, Nizamabad Shivar, Nizambad. While so, the respondents 3 and 4, in collusion with the 5th respondent, who claims to have been assigned the subject land, are now trying to dispossess the petitioners without issuing any notice and without following due process of law. Aggrieved by the same, this Writ Petition is filed. 2.

Heard counsel for the petitioners and the Government Pleader for Revenue appearing for respondents 1 to 4. 3.

The Government Pleader for Revenue submits that the subject land is government land.

Except filing copy of electricity bills, petitioners have not filed any documents to show that they are in possession. Further a Civil Suit filed by the 5th respondent against the petitioners, for Perpetual Injunction, is pending before the Principal Junior Civil Judge, Nizamabad 5.

Since the matter is before the Civil Court for adjudication, it is for the petitioners to agitate their rights in the said suit and

this Court is not inclined to entertain the Writ Petition to grant any relief.

In view of the same, this Writ Petition is dismissed. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending, shall stand closed.
