Writ Petition No.20255 of 2011 ORDER:

The relief sought for in the Writ Petition is to declare the action of the 3rd respondent (MNR Medical College) in issuing fee due statement dated 5.5.2011 and subsequent dates, demanding the petitioners to pay Rs.42,000/- for appearing in the backlog examinations, as arbitrary and illegal.

While permitting the petitioners to appear for the final examinations on depositing a sum of Rs. 15,000/-, this Court, by its order in W.P. No. 20255 of 2011 dated 19.7.2011, made it clear that the petitioners should fulfil all other conditions such as attendance etc, and would only then be permitted to appear for the aforementioned examinations. On the ground that the petitioners had failed to pay batta or to file proof of service of notice against the 3rd respondent, the Writ Petition came to be dismissed as against the 3rd respondent in terms of the order passed by this Court on 16.4.2015.

As the relief sought for in the Writ Petition is only against the 3rd respondent, and in as much as the Writ Petition has been dismissed against the 3rd respondent, the Writ Petition is liable to be dismissed against the other respondents also.

The Writ Petition is, accordingly, dismissed. Miscellaneous petitions, pending, if any, shall also stand dismissed. There shall be no order as to costs.

Writ Petition No. 22338 of 2007 ORDER:

Neither Sri M.V.Narasimham, learned counsel for the petitioner, is present nor is there any representation on his behalf. The relief sought for in the writ petition is to direct the respondents to consider the case of the petitioner for appointment to the post of Anganwadi worker at Anganwadi Centre of Katepalli B.C. Colony, Vinjamur Mandal, Nellore District.

Learned Government Pleader for Women Development and Child Welfare, would submit that in terms of the interim order passed by this Court on 22.10.2007, the petitioner's case was considered along with other eligible candidates and her candidature was rejected as she was over aged.

As the relief sought for by the petitioner is to consider her case and her case has been considered albeit pursuant to the interim order passed by this Court, the cause in the writ petition does not survive, and that the writ petition has become infructuous. The writ petition is, accordingly, dismissed. The miscellaneous petitions, pending, if any, shall also stand dismissed. There shall be no order as to costs.
