HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3883 OF 2013 ORDER:

In this petition filed under Section 482 Cr.P.C, petitioner seeks to quash the proceedings in C.C.No.758 of 2010 on the file of III Additional Chief Metropolitan Magistrate, Gajuwaka, Visakhapatnam, registered for the offence under Section 420 IPC.

When the matter came up for hearing, learned Assistant Public Prosecutor produced the letter dated 06.07.2018 of Sub-Inspector of Police, New Port Police Station, Visakhapatnam City and submitted that after filing of charge sheet, C.C.No.758 of 2010 was registered and the same was ended in acquittal vide judgment dated 15.12.2015 and therefore, the petition which is filed to quash the proceedings in C.C.No.758 of 2010 has become infructuous and hence the same may be dismissed.

In view of the above submission of learned Public Prosecutor, the Criminal Petition is dismissed as Infructuous. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
