THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25185 of 2017 ORDER:
This Writ Petition was filed challenging the notices dated 17.07.2017 issued by the third respondent to the petitioners asking them to remove the encroachments within seven days failing which with the assistance of the Roads and Buildings authorities, Revenue and Police, appropriate action would be taken.
When the matter is taken up for consideration, learned Counsel for the third respondent, on the basis of the written instructions, submits that the road on which the encroachments took place was declared as State Highway road one year back. In such a case, the third respondent will not have any jurisdiction to issue the notices.
In view of lack of jurisdiction to the third respondent, the impugned notices are set aside, and the Writ Petition is allowed. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
