THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION NO. 12990 of 2013 ORDER :

Heard both sides.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the second respondent in interfering with the civil dispute and calling the petitioners to the police station, as illegal and arbitrary.

When the matter came on 26.04.2013 on first occasion, none appeared on behalf of the petitioners and hence the matter was directed to be listed on 30.04.2013. Thereafter, it has been listed after four years.

A reading of the averments in the writ affidavit would show that the respondents-police are interfering with the civil dispute and calling the petitioners to the police station. The said allegation was made in the year 2013. Learned Government Pleader, on instructions, denies the allegations made in the writ affidavit.

Having regard to the above, the writ petition is closed, giving liberty to the petitioner to avail the remedies in accordance with law, in case the alleged interference by the police still persists. No costs. Consequently, miscellaneous petitions, if any pending, shall stand closed.
