THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.4141 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the online notification dated 21-01-2016 issued by the 3rd and 5th respondents herein in conducting recruitment for the post of Anganwadi of India and consequently setaside the same as per the law laid down in W.P.No.31374 of 2015 and batch dated 16-11-2015 and further declare that the writ petitioners are entitled to be appointed as Anganwadi worker."
Heard, Sri B. Geeta, learned counsel for the petitioners and learned Government Pleader for Women and Child Welfare for the respondents.
When the matter is called, it is submitted by learned counsel for the petitioners that the issue in the present writ petition is squarely covered by a common order of this Court in writ petition Nos.31374 of 2015 and batch, dated 16-11-2015 and a copy of the same is also filed along with the writ petition as material paper. Following the said order and for the reasons recorded therein this writ petition is also allowed with the following order:
Accordingly, the recruitment notifications challenged in the writ petition are set aside and consequently, the respondents are directed to consider the petitioners for appointment/promotion as Anganwadi Workers in the respective villages subject to their eligibility and suitability in the existing vacancies of the respective villages. Such consideration shall be completed within a period of
four (4) weeks from the date of receipt of a copy of this order. The writ petition is, accordingly, allowed.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
Office to annex the copy of the order in W.P.Nos.31374 of 2015 and batch.
