THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8458 OF 2015 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/accused seeking bail in crime No.55 of 2013 on the file of P.S., Maredumilli, East Godavari District, registered for the offence under Section 20(b)(ii)(c) of Narcotic Drugs and Psychotropic Substances Act (NDPS Act). Heard and perused.

The allegation against the petitioner herein is that he was found in possession of 120 Kgs of ganja.

On earlier occasion, the petitioner was released on bail, but due to his absence before the Court below, Non Bailable Warrant was issued and was arrested by the respondent/police. The Court below dismissed the bail application of the petitioner not only on the ground that he was absconding, but also on the ground that the contraband seized is of commercial quantity. Hence, this Court is not inclined to grant bail to the petitioner/accused. Liberty is given to the petitioner to move bail application at appropriate time.
