Mahalaxmi Communications v. The State Of Telangana
HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 34725 of 2018 ORDER:
The present writ petition came to be filed seeking the following relief:
" To declare the action of the 4th respondent in sealing the Meeseva Centre in the name and style as Mahalaxmi Communications, of the petitioner situated at H.No. 1-17, New Bus Stand, Mudhole village and Mandal, Nirmal district, without issuing any prior notice as illegal, arbitrary and in violation of principles of natural justice besides being without jurisdiction and contrary to the provisions of Article 21 of the Constitution of India and consequently direct the 4th respondent to unseal the Meeseva Centre in the name and style as Mahalaxmi Communications, of the petitioner situated at H.No. 1-17, New Bus Stand, Mudhole village and Mandal, Nirmal district."

At the time when the matter is taken up for hearing, learned counsel for the 2nd respondent, on instructions, would submit that since the petitioner along with his employee indulged in malpractices by issuing Lambada caste certificates to ineligible persons, the Meeseva centre came to be closed, basing on the report of the Tahsildar. However, the learned Government Pleader for Revenue would submit that all the (13) caste certificates issued by the petitioner have been cancelled. The
fact that no notice was given before closing the centre, is not in dispute.

Since the closure of the Meeseva came to be made without putting the petitioner on notice and without informing him the grounds on which the Meeseva has been closed/ locked, it can be said that the same is in violation of principles of natural justice. 4.
Having regard to the above circumstances, the authorities are directed to open the Meeseva Centre of the petitioner, in the name and style of Mahalaxmi Communications, situated at H.No. 1-17, New Bus Stand, Mudhole village and Mandal, Nirmal district, and thereafter, take action in accordance with the law. 5.
With the above direction, the writ petition is disposed of at the admission stage. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
