The case of the petitioner is that he was falsely implicated in Cr.No.43 of 2017 as A-4 in the said crime. The petitioner filed criminal petition No.2766 of 2017 and he was granted anticipatory bail and subsequently the F.I.R. was quashed in Crl.P.No.4292 of 2017 by this Court. Inspite of the same, an order of suspension dated 03-06-2017 was passed against the petitioner and being continued. The petitioner made a representation dated 17-06-2017 before the 2nd respondent to revoke the suspension order. But the order of suspension is not lifted and the petitioner was issued charge memo. Aggrieved by the order of suspension, the present writ petition is filed. A reading of the impugned order dated 03-06-2017 goes to show that the petitioner was suspended basing only on the registration of crime in Cr.No.43 of 2017 but the same is quashed.
In view of the same, the 2nd respondent is directed to pass orders on the representation of the petitioner dated 17-06-2017 for revoking of suspension order, as the basis for issuing said suspension order is criminal case which is quashed.
Accordingly, the writ petition is allowed to the extent indicated above. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
