HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8094 of 2016 ORDER:

This petition is filed by the petitioner - Accused No.1 under Section 438 of Criminal Procedure Code seeking to grant anticipatory bail to him in Crime No.26 of 2016 of Central Crime Station, Hyderabad, registered for the offences punishable under Sections 420, 468 and 471 IPC.

Heard and perused the material available on record. The allegations against the petitioner is that he along with the other accused, came to contract with the de facto complainant and represented that they intent to serve the unemployed youth of Muslim community by providing jobs in foreign countries and that believing their words, the de facto complainant contracted 32 persons and paid approximately Rs.55,00,000/- to the petitioners towards visa charges, but the petitioners did not provide the visas and when the de facto complainant asked them, they bluntly refused to give any visa. Learned counsel for the petitioner submitted that the petitioner is innocent of offences alleged against him and he was falsely implicated in the case.

Learned Additional Public Prosecutor opposed this petition by submitting that the offences alleged against the petitioner are serious in nature and custodial interrogation is necessary in this case. In view of the submission of the learned Additional Public Prosecutor, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, the Criminal Petition is dismissed. _______________ RAJA ELANGO, J June 24, 2016.
