HON'BLE SRI JUSTICE R.KANTHA RAO W.P.No.15961 OF 2015

ORDER

Heard learned counsel appearing for the petitioner and learned Standing Counsel appearing for 3rd and 4th respondents. This writ petition is filed seeking to declare the proceedings dated 21.01.2015 of the 4th respondent in terminating the petitioner from duties as Field Assistant, Tirumaladevarapalli Gram Panchayat, Kothacheruvu Mandal, Anantapur District, as arbitrary and illegal.

Learned counsel appearing for the petitioner submits that the petitioner was suspended without there being any specific allegation against him.

A perusal of the impugned proceedings goes to show that the petitioner was suspended on the ground that he is not discharging the duties as per the job chart.

Obviously, the said allegation is not specific. In any event, this Court is of the opinion that it would be appropriate to direct the Enquiring Authority to conduct enquiry and pass final order. Consequently, the Writ Petition is disposed of directing the Enquiring Authority to complete enquiry and pass final order within a period of four weeks from the date of receipt of a copy of this order. If the enquiry is not completed within the stipulated period, the order of suspension shall stand revoked. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
