THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR W.P. NO. 28371 of 2015 ORDER:

Heard learned counsel for the petitioner as well as Ms. Takur Rupa Singh, learned standing counsel appearing for the respondents 2 and 3.

The grievance of the petitioner is inaction of the respondents 2 and 3 in considering his request for grant of passport.

It appears that on verification of the antecedents, pendency of the criminal case against the petitioner was noticed. However, the learned counsel for the petitioner states that the petitioner has already sought appropriate permission from the Principal Junior Civil Judge, Punganur on 9.9.2015 in Crl.M.P.No. 1756 of 2015 in C.C.No. 81 of 2011 whereby the petitioner was permitted to travel abroad between 15.9.2015 and 30.10.2015 subject to filing an undertaking as detailed in the said order. The learned counsel for the petitioner states that the said order was also brought to the notice of the respondents 2 and 3 on 11.9.2015.

In the circumstances, this writ petition is disposed of directing the respondents 2 and 3 to consider the petitioner's application for grant of passport in the light of the aforesaid order and pass appropriate orders expeditiously. Miscellaneous applications, if any, shall stand closed. No order as to costs.
