HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 34580 of 2018 ORDER:

1) Heard learned counsel for the petitioners and learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage itself.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.3 in not taking on file and adjudicating the suspension petition vide un-numbered I.A...../2018 in appeal No......of 2018, dated 29.08.2018, filed along with appeal, against the order of the Tahsildar concerned, dated 16.08.2018, as illegal and arbitrary.

3) Learned counsel for the petitioners would submit that the present writ petition came to be filed in view of the threat of dispossession by the respondents, without passing any orders in the interim application in the appeal filed by the petitioners.

4) Having regard to the above, the Sub-Collector, Nuzvid, Krishna District, Vijayawada, shall take the case on file, if it is otherwise in order and then pass orders in the interim application filed along with the appeal, in accordance with law, after hearing all the concerned, as early as possible, preferably, within a period of two weeks from the date of

receipt of a copy of the order. If the petitioners are in possession, no dispossession shall take place, till passing of the orders in the said interim application.

5) With the above direction, the writ petition is disposed of.
