No representation for petitioner.
Heard Assistant Government Pleader for Home.
Petitioner prays for mandamus directing respondents to register complaint dated 07.03.2011 filed with respondent No.4 and cause investigation in accordance with law and the inaction in registering the case as illegal, arbitrary and amounts to refusing to exercise the jurisdiction conferred on 6th respondent.
At request of respondents on 07.04.2011, the writ petition has been adjourned.
The Assistant Government Pleader places on record the written instructions dated 08.04.2011 and the concluding portion of written instructions read thus:
"It is submitted that as stated supra, the enquiry revealed that there is a civil dispute pending with regard to the said survey numbers on the file of Hon'ble III Additional Junior Civil Judge Court, Guntur vide O.S.No.1413 of 2004 and no such incident took place on 15.02.2011 as alleged by petitioner, therefore, this respondent had advised the petitioner to approach the competent civil Court for redressal and the report is being submitted to the SubDivisional Police Officer, South Sub-Division, Guntur.
Since the respondent had already advised the petitioner to approach the competent civil Court, it is always open to petitioner to work out his grievance within the four corners of law.
The Writ Petition is dismissed. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
