THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.8130 OF 2017 ORDER :

This writ petition is filed seeking writ of mandamus directing the Sub-Registrar, Neknampur at Gandipet, R.R.District-2nd respondent not to register any properties to be sold by the respondents 3 to 8 till the disposal of the D.V.C.No.180 of 2016 on the file of III Metropolitan Magistrate, Erramanzil, Hyderabad.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Stamps and Registration. Admittedly, the petitioner filed D.V.No.180 of 2016 on the file of III Metropolitan Magistrate and it is for her to obtain appropriate orders from the said Court. On mere pendency of D.V.C before the Court below, this Court cannot direct the 2nd respondent not to register any properties to be presented by the respondents 3 to 8, by exercising jurisdiction under Article 226 of the Constitution of India.

In view of above, I do not see any reason to entertain the writ petition and accordingly the same is dismissed. However, it is open for the petitioner to avail alternate remedy in accordance with law. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition, shall stand dismissed.
