HON'BLE SRI JUSTICE C. PRAVEEN KUMAR I.A.No.2 of 2018 In/and WRIT PETITION No.34643 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents 3 and 4 in interfering with the mining activities of the petitioner firm, thereby not issuing the transit permits without any manner of right, as illegal and arbitrary. 2) Pending the writ petition, the petitioner filed I.A.No.2 of 2018 to implead " the Chairman, Andhra Pradesh Pollution Control Board, Vijayawada, Andhra Pradesh" as fifth respondent, since clearance from the said Pollution Control Board is necessary. Having regard to the facts and circumstances of the case, I.A.No.2 of 2018 is allowed. 3) Though various grounds are raised in the writ petition, the learned counsel for the petitioner would submit that though the petitioner made online application on 11.04.2018, till date the same is not considered. In support of the same, he placed on record the Acknowledgment Slip for TOR, dated 11.04.2018.

4) Sri G.Ramachandra Rao, learned Standing Counsel for the fifth respondent, would submit that, if the said application is pending consideration, the Board may be directed to pass appropriate orders.

5) Having regard to the above, the writ petition is disposed of, directing the fifth respondent-Pollution Control Board to pass appropriate orders on the representation made by the petitioner on 11.04.2018, as early as possible, preferably, within a period of two to three weeks from the date of receipt of a copy of the order. As stated earlier, I.A.No.2 of 2018, to implead the Pollution Control Board as fifth respondent is allowed.

6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
