THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.163 OF 2016 ORDER:

The petitioner has preferred the present criminal revision case by invoking the provisions under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.,) being aggrieved by the order dated 14.10.2015 passed in Crl.M.P.No.763 of 2015 in C.C.No.254 of 2015 passed by the II Additional Judicial Magistrate of First Class, Kovvur, whereby the Court below returned the petition of the petitioner seeking to return of the passport is dismissed.

Heard and perused the material available on record. Learned counsel for the petitioner submits that earlier he used to work in gulf countries and in view of the present case, he lost his job and now he is jobless. He further submits that petitioner has to go to gulf countries to get job and that the Court below erroneously dismissed the petition seeking for return of the passport of the petitioner. He further submits that the petitioner is ready to represent his case before the Court below through his counsel.

Considering the facts and circumstances of the case, the petitioner is directed to file an application before the Court below seeking return of the passport, and on such application being filed, the Court below is directed to return the passport to the petitioner herein on execution of a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety to the satisfaction of the Magistrate concerned. The petitioner is also directed to represent the case before the Court below through his advocate on all hearing days.

With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions pending in this revision, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 03.06.2016 pln
