THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.20833 OF 2017 ORDER:

The petitioner claims to be the wife of one Appala Narasaiah, who died long back. The land of an extent of Acs.0.11 guntas in Survey No.1054/2 of Ramanujavaram Village, Manuguru Mandal, Bhadradi Kothagudem District along with other lands was acquired for the purpose of Thermal Power Station at Ramanujavaram Village. The petitioner attended the award enquiry. During the award enquiry, it came to light that the land was sold away long back to one P. Purnachandraiah. In those circumstances, the award amount was not paid to anyone and the Land Acquisition Officer opined that it is a fit case for reference to Authority. Now the petitioner submitted an application dated 24.03.2016 and when no action was taken on the said application, the present writ petition is filed.

In the Award itself since the Land Acquisition Officer opined that there is a dispute of title and nobody has proved their title, and also in view of the application of the petitioner, the respondents 2 and 3 are directed to take appropriate action on the application of the petitioner dated 24.03.2016 received by the third respondent on 02.04.2016 within a period of thirty days from the date of receipt of a copy of this order. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in the writ petition shall stand closed. There shall be no order as to costs.
