ORDER
The petitioners/A1 and A2 filed this criminal petition under Section 482 Cr.P.C., seeking to quash the proceedings in S.C.No.398 of 2014 on the file of Metropolitan Sessions Judge at Nampally, Hyderabad, registered for the offence punishable under Section 307 r/w 34 IPC, against them.
2. The averments in the charge sheet would disclose that due to disputes about parking of vehicle in the apartment, A1 and one Naresh came to the complainant on 20.12.2012 at night time in drunken stage and abused him in filthy language and on 28.12.2012 at 6.00 AM., when the complainant left home for his morning walk, A1, A2 and his brothers, who gathered at parking place, were attacked the complainant with cutting plier and screw driver apart from beating him with legs and hands. They pierced the complainant on his right eye, nose, thereby he sustained injuries and fell unconscious. On a private complaint, the aforesaid case was registered against the petitioners/A1 and A2.
3. Today, when the matter came up for hearing, the second respondent/de facto complainant and the petitioners/A1 and A2 are present and are identified by their respective counsel. They filed Crl.M.P.Nos.6256 and 6257 of 2016 seeking to compound the offences alleged against the accused and to quash the
proceedings against them. They also produced the xerox copies of their Identity Cards. The second respondent stated that the matter has been settled out of the Court and he does not want to prosecute the petitioners/A1 and A2 in the aforesaid crime. Thus, he prays to quash the proceedings against them.
4. In view of the compromise arrived at between the parties, continuation of criminal proceedings against the petitioners/A1 and A2 would be a futile exercise. Therefore, it is just and proper to quash the criminal proceedings against the petitioners/A1 and A2.
5. Accordingly, the Crl.P.M.P.Nos.6256 and 6257 of 2016 are ordered and the Criminal Petition is allowed and the proceedings in S.C.No.398 of 2014 on the file of Metropolitan Sessions Judge at Namaplly, Hyderabad, are quashed against the petitioners/A1 and A2. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
