Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies for respondents. 2.

Petitioner challenges the order of suspending the authorization, pending enquiry under Section 6-A of the Essential Commodities Act. Primarily, it is challenged on the ground that the suspension order do not prescribe period for which the suspension is operated.

This Court by order dated 11.12.2015, granted interim direction as prayed for.

According to learned counsel for the petitioner, pursuant to the interim order of this Court, petitioner is continuing to operate the fair price shop dealership and there is no further progress in the enquiry.

Having regard to the fact that it was a temporary suspension without mentioning the period of suspension and as this Court granted interim direction on 11.12.2015, I deem it proper to set aside the order of suspension dated 08.12.2015. 6.

Accordingly, the Writ Petition is allowed. However, this order does not come in the way of competent authority in taking action as warranted by law, under the Essential Commodities Act. Pending miscellaneous petitions shall stand closed. __________________ P.NAVEEN RAO,J 8th November, 2018 Rds
