When the matter is taken up, written instructions dated 27.09.2018 furnished by the Sub-Inspector of Police & SHO, Lakkavaram Police Station, West Godavari District are placed on record by the learned Government Pleader for Home. The said instructions read as under: "2.
It is submitted that basing on the complaint of one Malladi Venkata Satya Ram Prasad, Panchay3t Secretary, Lakkavaram Village, Jangareddigudem Mandal, dt. 07.08.2018, a case in Cr.No.96/2018, dt. 07.08.2018, u/s. 447, 427 IPC was registered on the file of the Lakkavaram Police Station, against the 1' petitioner herein, wherein after completion of investigation filed charge sheet on 18.08.2018 and the case is now pending trial vide CC No. 570/18 on the 1116 oc the Hon'ble JFCM Court Jangareddidugem.

It is submitted that it is true that the VIP No. 12935/2018 filed by the petitioners against the revenue authorities are pending on the file of the Hon'ble Court, wherein the respondents herein are not the parties to the same.

It is submitted that the allegations of the petitioners that the at the instigation of the revenue authorities and on the instructions of the 3rd respondent, the respondents 4 & 5 started interfering with the civil issues by directing the petitioners not to enter into the land in question, by summoning them to the police station in the Last week and warned them with dire consequences, are all false, baseless. The respondents 4 & 5 are not creating hurdles for the petitioners' agricultural operations in the said land, as alleged in the writ petition. All these false allegations against the respondent police authorities are concocted only for the sake of filing this writ petition and the same are hereby specifically denied. In fact, the 5th respondent has registered the Cr.No.96/2018, dt. 07.08.2018, u/s.
447, 427 IPC against the 1st petitioner herein and filed charge sheet therein on 18.08.2018, strictly in accordance with law and as per the provisions of Criminal Procedure Case. As stated supra, the said case is presently pending trial vide CC No. 570/18 on the file of the Hon'ble JFCM Court, Jangaredigudem.

It is submitted that the petitioners have suppressed die material fact of registration of Cr.No. 96/2018. dt. 07.08.2018, u/s. 447, 427 IPC against the 1st petitioner herein, filing of charge sheet therein on 18.08.2018 and pendency of the same for trial vide CC No. 570/18 on the file of the Hon'ble JFCM Court, Jangareddigadem."

On noticing the said instructions, a request is made by the learned counsel for the petitioners to dispose of the writ petition by placing on record the said instructions.

Accordingly, the writ petition stands disposed of, by placing on record the above said instructions dated 27.09.2018 furnished by the SubInspector of Police & SHO, Lakkavaram Police Station, West Godavari District.
