Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.
The petitioner is stated to be a HIV patient. He was allotted a shop in Rythu Bazar, Patamata, considering his disease, by order dated 29.10.2010. It was renewed from time to time and ultimately an order was passed on 11.09.2014 asking him to vacate the same since he has already completed three years. Challenging the same, the petitioner filed W.P.No.28429 of 2014 and the same was dismissed in view of the earlier order of this Court in W.P.No.33549 of 2014, dated 10.11.2014. The petitioner preferred W.A.No.1664 of 2014 to the Division Bench, and it was disposed of on 30.12.2014. The order of the Division Bench indicated that the petitioner was already evicted from the shop. Learned Counsel for the petitioner submits that the petitioner submitted a representation to the authorities on 01.06.2015 based on the proceedings given to the physically disabled persons on 17.04.2015 allowing them to continue in the shops.
In view of the above, this Writ Petition is disposed of directing the second respondent to consider the representation of the petitioner dated 01.06.2015 and pass appropriate orders in accordance with law, within a period of thirty days from the date of receipt of a copy of this order. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
