THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7653 OF 2016 ORDER:

This petition is filed by the petitioner-accused No.1 under Section 438 Cr.P.C. seeking to modify the order dated 26.4.2016 passed in Crl.M.P.No.1324 of 2016 in C.C.No.116 of 2015 by the XIV Metropolitan Magistrate, Cyberabad at L.B. Nagar. Heard and perused the material available on record. While granting bail to the petitioner-A1, the learned XIV Metropolitan Magistrate imposed a condition directing him to furnish personal bond for a sum of Rs.20,000/- with two sureties to the satisfaction of the Court and directing him to appear before the Court on every date of adjournment and directing him not to leave the country without prior permission of the Court, vide order in Crl.M.P.No.3644 of 2015. Later, the petitioner filed Crl.M.P.No.1324 of 2016 seeking to relax the conditions imposed by the learned Magistrate in Crl.M.P.No.

3644 of 2015. The learned Magistrate allowed the petition directing the petitioner to leave the Country on a condition of furnishing One lakh with two sureties. The learned Magistrate directed that the petitioner shall engage a person to represent on his behalf on every date of adjournment so as to inform him about the stage of the case, and further directed that he shall appear before the Court as and when informed through his counsel failing which the amounts shall be forfeited to the Government. Aggrieved by the said conditions, the petitioner filed this petition. The learned Additional Public Prosecutor opposed this petition.
