THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.29831 OF 2017 ORDER:

Petitioner claims that he is the owner of land admeasuring Ac.0.20 gts in Survey No.116/O situated in Hasanmirapur Village of Dubbaka Mandal, Siddipet District. Though it is a private property of the petitioner, the fourth respondent is trying to dispossess the petitioner and in that process, he visited the subject property on 16.08.2017 and directed the petitioner not to enter into the subject land.

Ordinarily, the Government officials do not interfere with the possession and enjoyment of private property. It is not known as to why the petitioner alleges that the fourth respondent was enquiring with his possession and directed him not to enter into the subject land. The facts on record are not clear.

Hence, liberty is granted to the petitioner to make a representation to the Tahsildar in writing enclosing all the documents in support of his claim of ownership. Such representation should be made within two weeks from the date of receipt of a copy of this order. If such representation is made within two weeks as prescribed above, the Tahsildar shall examine the claim of the petitioner and furnish a reply to the petitioner within a period of four weeks thereafter. If the petitioner is in possession of the subject property, till a decision is taken by the Tahsildar following due process of law as required, no coercive steps shall be taken against the petitioner.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
