This criminal petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/A.3 seeking enlargement on bail in connection with Crime No.868 of 2025 of Banjara Hills Police Station, Hyderabad District, registered for the offences

punishable under Sections 143(3) and 111 of the BNS and Sections 3, 4 and 5 of the PITA.

The brief facts of the case are that, on 23.10.2025, on reliable information, the police conducted a raid at R-Inn Hotel at Banjara Hills, wherein, they found accused Nos.2 and 3 organizing prostitution at hotel and they recorded the statement of victims. According to the prosecution, the petitioner herein is the sub-organizer and as such, the police registered a case against the petitioner herein showing him as accused No.3.

Heard Sri R. Eswar Chander, learned counsel for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that the petitioner herein is in jail from 23.10.2025 and even according to the prosecution, he is working as a receptionist in the hotel and accused No.1 is the owner of the said hotel and he is not aware of the said running of prostitution activities in the hotel and he is innocent of the said allegations and LWs 1 to 11 witnesses were already examined and the

investigation was already completed and prayed this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the investigation is still pending and the allegations against the petitioner herein are serious in nature and other accused persons have to be arrested and prayed to dismiss this petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail from 23.10.2025 and even according to the prosecution, he is shown as a receptionist of the hotel and as seen from the record, LWs 1 to witnesses were already examined including the investigating authority.

Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner/A.3, subject to the following conditions: i.

The petitioner/A.3 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two local

sureties for a like sum each to the satisfaction of the learned Additional Sessions Judge for the Trial of Jubilee Hills car Bomb Blast case-cumAdditional Family Court-cum-XXIII Additional Chief Judge-cum-IX Additional Sessions Judge, Hyderabad.

ii.

The petitioner/A.3 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner/A.3 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed.

Miscellaneous applications, if any pending, shall stand closed.
