THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.958 of 2013 ORDER:

This Civil Revision Petition, under Article 227 of the Constitution of India, is filed challenging the order, dated 10.12.2012, passed in Interlocutory Application No.1675 of 2012 in Original Suit No.925 of 2008 by the Principal Junior Civil Judge, Eluru, whereunder and whereby, the petition filed under Order XVI Rule 5 of the Code of Civil Procedure, 1908 to issue summons to the proposed witness, was dismissed.

As per the information received by this Court through ecourts website, the main suit was disposed of on 17.05.2014 by the trial Court, as such, the petition has become infructuous. Accordingly, the Civil Revision Petition is dismissed as infructuous. However, this order will not preclude the petitioners from taking appropriate steps to adduce additional evidence under Order XLI Rule 27 CPC in the appeal, if so advised.
