Mr. G. Eswara Rao, v. State Of Telangana, Represented By Its Principal Secretary,
HON'BLE SRI JUSTICE CHALLA KODANDA RAM W.P.No.20642 of 2004
ORDER
On 10.03.2015, this Court upon noticing that State of Andhra Pradesh has not been made as party (Now State of Telangana) and the Government of Andhra Pradesh, represented by its Principal Secretary, was arrayed as the 1st respondent, directed the petitioners to take steps to implead the State of Telangana and adjourned the matter to 27.07.2015 with a caution that failure to take steps in this regard by the next date of hearing would entail dismissal of the writ petition summarily. A verification of the record reveals that no application seeking to implead the State of Telangana as party respondent is filed.
Learned Assistant Government Pleader submits that no such application has ever been made.
At this stage, learned counsel appearing for the petitioners submits that in view of the judgment
of the Apex Court in State of A.P. v. Prameela Modi[1] wherein the first petitioner herein was the respondent therein, the cause in this writ petition does not survive for adjudication.
Accordingly, the Writ Petition is dismissed as infructuous and also for non-compliance of the order dated 10.03.2015. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
