THE HON'BLE SRI JUSTICE RAJA ELANGO Crl.R.C. No.529 of 2016 ORDER :

Petitioners preferred the present Criminal Revision Case by invoking the provisions under Sections 397 and 401 of the Code of Criminal Procedure being aggrieved by the order dated 13-11-2015 passed in P.R.C.No.12 of 2015 by the II Additional Judicial First Class Magistrate, Kovvur, West Godavari District, wherein and whereby the learned Magistrate directed the petitioners to obtain bail in order to commit the case to the Court of Sessions. This Court perused the records and heard the arguments.

It is true that at the time of committing the case either the petitioners should be on bail or they should be remanded to judicial custody, therefore, the learned Magistrate insisted the petitioners to obtain the bail. Considering the facts and circumstances of the case, the petitioners are directed to surrender before the Magistrate concerned and file an application to grant bail and on such surrender and filing of the application, they shall be enlarged on bail on each of them executing a personal bond for a sum of Rs.1,000/- (Rupees One

Thousand only) with one surety for a like sum each to the satisfaction of the said Magistrate. Thereafter, the learned Magistrate concerned is directed to commit the case to the Court of Sessions.

The Criminal Revision Case is disposed of accordingly.

Miscellaneous petitions, if any, filed in this revision shall stand closed.
