THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5014 OF 2016 ORDER:

This petition is filed by the petitioners-accused under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.20 of 2016 on the file of the XIII Additional Chief Metropolitan Magistrate, Hyderabad.

Heard and perused the material available on record. The petitioners are alleged to have committed the offence punishable under Sections 498-A and 406 IPC and Sections 4 and 6 of the Dowry Prohibition Act.

Learned Counsel for the petitioners submitted that NBWs are pending against the 1st petitioner-A1 and look out notice has also been issued against the 1st petitioner.

Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

"The lookout notice issued against the 1st petitioner is hereby recalled. The 1st petitioner is directed to appear before the Court concerned on or before 15th July, 2016 and to move an application seeking to recall NBWs issued against him. On such appearance and on such application being filed, the Court concerned is directed to recall NBWs issued against him and release him. Further, the 1st petitioner is also at liberty to move an application under Section 205 Cr.P.C. for dispensing with his presence before the trial Court. On such application being filed, the trial Court is directed to consider the same in accordance with law.

The presence of the 2nd petitioner before the trial Court is dispensed with except on the date of framing of

charges, on the date of examination under Section 313 Cr.P.C. and on the date of pronouncement of judgment. The 2nd petitioner is directed to be represented through a Counsel before the trial Court on all hearing dates." Accordingly, the Criminal Petition is disposed of.

Consequently, the miscellaneous petitions pending in this petition, if any, shall stand closed.
