The present writ petition came to be filed seeking issuance of writ of mandamus, declaring the action of the respondents 3 to 7 in not stopping the illegal construction and installation of statue of Late Pranay Kumar on the main road of Miryalguda Town in Nalgonda district, as illegal, arbitrary and unconstitutional.

On 26.09.2018, this Court, while adjourning the matter to 23.10.2018, observed that the Government Pleader for Home submitted that the II Town Police Station, Miryalaguda issued a notice asking the father of the deceased (Pranay Kumar) not to erect the statute, unless and until permission is taken from the concerned authorities. 3.
Today, when the matter is taken up for hearing, the Government Pleader filed counter, stating that in view of the judgment of the Apex Court in S.L.P. (Civil) No. 8519 of 2006, directions have been issued to all the authorities not to grant permission for installation of any statue or construction of any structure in public roads, pavements, sideways and other public utility places, and to follow the directions of the Apex Court. The Government also issued G.O.Ms.No. 18, dated 18.02.2013 in that regard. It is further stated that as the police observed erection of the statue of Late Pranay Kumar was without permission, and that a R&B road near Miryalaguda town was damaged, they instructed the concerned not to erect the statue, until permission is granted by the concerned authorities.

On a perusal of the contents in the counter, it is clear that no permission has been granted by the respondents to erect the statue of late Pranay Kumar, and instructions were also issued to the concerned not to erect the statue unless permission is granted by the authorities. 5.
In view of the above, nothing remains for adjudication in the present writ petition. Accordingly, the writ petition is closed. No order as to costs.
