THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10191 OF 2015 ORDER:
This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.56 seeking grant of bail in P.R.C.No.146 of 2014 in S.C.No.188 of 2015 on the file of the Metropolitan Sessions Judge, Visakhapatnam, in connection with crime No.17 of 2008 of G.K.Veedhi Police Station, registered for the offences under Sections 147, 148, 307, 302, 396 read with Section 149 IPC, Sections 25 and 27 of the Indian Arms Act, Sections 3 and 5 of the Explosive Substances Act, Section 8(1)(b) of the A.P.Public Security Act and Sections 15, 16, 18, 18(a), 20 and 39 of the Unlawful Activities (Prevention) Act. Heard and perused the material available on record. It is alleged that the petitioner/A.
56 is a Central Committee Member of Maoists Party and on the date of incident, he along with other accused way laid in the forest area and blasted two land mines against the police party, resulting in death of one Head Constable and a Senior Commando No.1773. It is further alleged that the petitioner/A.56 was in underground for the last many years after the said incident and after great efforts, he was arrested in Assam in another case and he was produced on PT warrant. The earlier bail application of the petitioner herein was dismissed by this Court and there is no change of circumstances and as such, this Court is not inclined to grant bail to the petitioner herein.
