ORDER

This writ petition is filed challenging the action of respondents 2 to 4 in proposing to pay compensation to respondent No.5 in respect of the land in an extent of Ac.18.92 cents situated in Kamayyapalem Village, Jellugumilli Mandal, West Godavari District, without considering the representation of the petitioner dated 6.6.2017.

There is no dispute with regard to acquisition of land, which culminated in passing an Award on 8.3.2017. The awarded amount has not been paid to any of the parties and it is with the authorities.

Learned counsel appearing for the petitioner submits that though the award was passed in the name of the petitioner, the compensation amount was sought to be disbursed in favour of the 5th respondent.

In view of the dispute between the petitioner and the 5th respondent, this Court feels that it is a fit case to refer the matter to the authority constituted under Section 51 of the Right to Fair Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013. The District Collector, West Godavari, Eluru, shall take appropriate steps within a period of thirty (30) days for referring the matter to the said authority and it is open to the petitioner and the 5th respondent to appear before the said authority and prove their claim for compensation.

Accordingly, Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 13th September, 2017 rkk
