THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No. 10257 OF 2018 ORDER:
This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973, by the petitioner - accused No.2 viz., V. Raghavulu, to quash the proceedings against him in Calendar Case No.380 of 2014, pending on the file of the learned Additional Junior Civil Judge - cum - XVII Metropolitan Magistrate, Cyberabad at Rajendranagar, registered for the offences punishable under Sections 420, 468 and 471 of the Indian Penal Code, 1860, on various grounds.
2. During hearing, learned counsel for the petitioner, Sri M.V. Krishna Mohan, mainly contended that though crime was registered in the year 2009 and charge sheet was filed in the year 2011, no steps were taken to complete the trial, and LW.1 - de facto complainant being a Police Officer is not even appearing before the trial Court to record his evidence, and on account of delay, the petitioner is facing lot of difficulty who is going to retire within six months and requested to pass appropriate order.
3. In view of the above submission, without touching merits of the grounds raised in the petition, since the petitioner is going to retire within six months, the learned Additional Junior Civil Judge - cum - XVII Metropolitan Magistrate, Cyberabad at Rajendranagar, is directed to dispose of Calendar Case No.380 of 2014, pending on its file, as
MSM,J Crl.P No.10257 of 2018 expeditiously as possible, in any event not later than five (05) months from today.
Accordingly, the present Criminal Petition is disposed of. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Criminal Petition stand closed.
