Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor. Perused the material on record.
2. The present Criminal Petition came to be filed by the petitioners/A.7 & A.8 under Section 438 Cr.P.C., seeking release in the event of their arrest in connection with Crime No.87 of 2016 of Yemmiganur Town Police Station, Kurnool District, registered for the offences punishable under Sections 147, 148, 324, 307 read with 149 IPC.
3. The case of the prosecution as per Case Diary is that on 12.06.2016 when the informant having found A.1 and A.2 grazing their oxen in his field, objected to the same, then A.1 and A.2 and also A.3 to A.9 attacked him and his relatives, beat them with sticks and sickles causing them injuries. A.7 beat the informant's son by name Pedda Ranganna with sticks causing bleeding injuries, whereas A.8 beat his another son by name Ranga Swamy with a stick on his waist causing invisible injury. Basing on these allegations, the present case came to be registered.
4. As seen from the record all the other accused were granted regular bail. Having regard to the allegations made against the petitioners, I am not inclined to grant anticipatory bail.
5. Accordingly, the Criminal Petition is disposed of directing the petitioners to surrender before the concerned Court and move
an application for regular bail after giving prior notice to the Public Prosecutor, in which event, the same shall be considered by the concerned Court, in accordance with law, at the earliest. _______________________ JUSTICE C. PRAVEEN KUMAR Date:20.07.2016 INL
