HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.34906 OF 2018 ORDER:

This writ petition came to be filed seeking to declare the action of the 2nd respondent, in passing the impugned order dated 12.9.2018, without jurisdiction and in violation of principles of natural justice and contrary to the order dated 26.12.2017, passed by this Court in W.P.No.44142 of 2017.

The grievance of the petitioner is inclusion of his land, admeasuring Ac.3-77 guntas, situated in Sy.No.11 of Kothaballuguda, Lagisetti Palem, Sabbavaram, Visakhapatnam District, under the prohibition list, notified under Section 22(A)(1)(a) of the Registration Act. In the light of the judgment of this Court in G. Satyanarayana and others v The Government of Andhra Pradesh and others1, the Government of Andhra Pradesh has issued G.O.Ms.No.300 Revenue (Assn.1) Department, dated 05.07.2016, whereunder, a Committee was directed to be constituted before whom the objections relating to the inclusion of the property under Section 22(A)(1)(a) of the Registration Act, can be agitated, the Writ Petition is disposed of giving liberty to the petitioner to approach the Committee, in terms of the G.O.Ms.No.300, which shall consider and pass appropriate orders in accordance with law. No costs.

Consequently, Miscellaneous Petitions, pending if any, shall stand closed.
