HON'BLE SRI JUSTICE A.V. SESHA SAI CIVIL MISCELLANEOUS APPEAL No. 1018 OF 2012 ORDER:

On reference to the Lok Adalat, the Lok Adalat, on 13.08.2016, passed the following Award:

"The above case between the parties having been referred for determination to the Lok Adalat and the parties having compromised the case/matter, the following Award is passed in terms of the settlement: 1.

Sri Ch. Indrasena Reddy, learned counsel for the applicants and Sri Akshay Kumar, Legal Officer for ICICI Lombard General Insurance Company Limited are present. The matter has been settled between the parties. Both parties have amicably settled their dispute and in pursuance of the compromise between them, the claimants agreed to receive a total compensation of Rs.4,60,000/- as against the awarded amount of Rs.5,12,228/- in full quittance of all their claims against the respondents insurance company.

It is further stated that the respondent has deposited the entire awarded amount within the stipulated time as per the award and therefore the claimants are not entitled for any interest by way of default. 3.

Accordingly, award is passed for the above said agreed amount of Rs.4,60,000/- in favour of claimants together with accrued interest if any and the balance amount of Rs.52,228/- together with accrued interest if any shall be refunded to the respondent insurance company. The claimants shall share their amounts of compensation as per the orders of the learned Commissioner.

The applicants are permitted to withdraw entire amount as and when deposited by the insurance company.

In terms of the compromise arrived at between the parties, this case is disposed of.

The parties are informed that the Court fee, if any, paid by any of them before lower Court shall be refunded."

In view of the above, there shall be a Decree in accordance with the said Award. Accordingly, the Civil Miscellaneous Appeal stands disposed of. Miscellaneous petitions, if any, shall stand closed. No order as to costs. _____________________ A.V. SESHA SAI, J Date: 22.09.2016 ES
