THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.36106 of 2018 ORDER:
When the matter is taken up, written instructions, dated 26.09.2018, furnished by the Sub Inspector of Police, Madhapur Police Station, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, read as under:
"It is respectfully submitted that on receipt of communication about the filing of the present writ petition by the petitioner herein, this respondent police station including the Station General Diary as to whether any complaint alleged to have been submitted by the petitioner herein dated 25.6.2018 and 29.7.2018 were received or not. The records revealed that till date, the petitioner did not approach this respondent police station nor submitted any complaints dt. 25.6.2018 and 29.7.2018 respectively and hence no action was taken.
It is humbly submitted that this respondent is ready and willing to initiate action if the petitioner approaches this respondent police with any fresh complaint or with the similar complaints.
In the absence of receipt of any complaint from the petitioner herein, this respondent is unable to initiate any action.
It is pertinent to submit that in due obedience to the filing of the writ petition by the petitioner herein, this respondent is trying to contact the petitioner for obtaining fresh complaint to take action on the same". By placing on record the above written instructions, Writ Petition is disposed of, with a liberty to the petitioner herein to file an appropriate complaint before the
respondent-police for taking action, in accordance with law. There shall be no order as to costs.
