6. 01.04.2024 Dr.GRR,J I.A.No.2 of 2024 In I.A.No.1 of 2024 In Crl.P.No.11930 of 2022 This application is filed by the petitioner-accused No.2 to relax the condition imposed in I.A.No.2 of 2023 to attend before the Station House Officer, Prohibition & Excise Police Station, Secunderabad on every second Saturday of every month between 10:30 AM to 12:00 PM till filing of the report vide order dated 11.01.2024 in Crl.P.No.11930 of 2022 in COR No.63 of 2022.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

Learned counsel for the petitioner submitted that the petitioner was granted anticipatory bail vide order dated 14.02.2023 in Crl.P.No.11930 of 2022. While granting anticipatory bail, this Court imposed a condition that the petitioner shall report before the Station House Officer, Prohibition & Excise Police Station, Secunderabad on every Monday between 10:30 AM to 12:00 PM till filing of final report. The petitioner filed I.A.No.1 of 2023 to relax the said bail condition and this Court vide order dated 09.06.2023 further directed the petitioner to report before the Station House Officer, Prohibition & Excise Police Station, Secunderabad on

Crl. Petition No.11930 of 2022 second Saturday of every month between 10:30 AM to 12:00 PM instead of every Monday, till filing of the report. She further submitted that the petitioner regularly appeared before the Station House Officer by complying the condition imposed by this Court, but even after completion of a period of two years, the police failed to file the charge sheet and as such, prayed to relax the said condition.

Learned Additional Public Prosecutor also stated that the petitioner was appearing regularly as directed by this Court vide order dated 09.06.2023.

Perused the record.

Considering that the petitioner is an old lady and appearing before the Station House Officer, Prohibition & Excise Police Station, Secunderabad as directed by this Court in Crl.P.No.11930 of 2022 dated 14.02.2023 as well as in I.A.No.1 of 2023 dated 09.06.2023 and as the charge sheet is not yet filed, it is considered fit to relax the condition imposed in the order dated 14.02.2023 and 09.06.2023 by this Court in Crl.P.No.11930 of 2022. However, the petitioner is directed to appear before the Investigating Officer as and when the Investigating Officer requires her presence for the investigation of the case.

Accordingly, this application is allowed, relaxing the condition imposed in the order dated 14.02.2023 and 09.06.2023 by this Court in Crl.P.No.11930 of 2022. __________ Dr.GRR,J ss
