ORDER:

This writ petition filed for the following substantive relief: ".....to issue an appropriate writ, order or direction, more in the nature of Mandamus declaring the auction notification issued by the respondent dt.2.1.2012 proposing to sell the residential house of the petitioner for recovery of an amount of Rs.4,76,690/- as at 31.3.2012, without giving credit to the amount of Rs.60,000/- which were paid by 14.7.2011 as being illegal, arbitrary and consequently set aside the same, and pass such other order or orders...."

At the hearing, Mr.V.Nitesh, learned counsel for the petitioner, submitted that the matter has been settled out of Court.

In view of the aforesaid submission of the learned counsel for the petitioner, the Writ Petition is disposed of as settled out of Court.

As a sequel to disposal of the writ petition, interim order, dated 14.02.2012 is vacated and W.P.M.P.No.4664 of 2012 filed by the petitioner for interim relief shall stand disposed of as infructuous.
