HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.R.C.No.503 of 2013 JUDGMENT:

This Criminal Revision Case is directed against the Order of the learned Special Judge for Trial of N.D.P.S. Act (I-Additional Sessions Judge), Khammam dated 28.11.2012 dismissing Crl.M.P.No.263 of 2012 in S.C.No.9 of 2012 filed by the revision petitioner under Section 451 Cr.P.C. for release of the Car bearing No.MH-26-S-0919 in his favour.

The property involved in this case is said to be a Car bearing No.MH-26S-0919. At the conclusion of the trial in S.C.No.9 of 2012, the said vehicle has been directed to be confiscated to the State. In spite of that, the revision petitioner claiming to be the owner of the vehicle has filed the aforesaid Crl.M.P.No.263 of 2012 before the trial Court seeking to release the said vehicle. However, the trial Court has dismissed the said petition on the ground that the vehicle in question has already been ordered to be confiscated to the State. I do not find any irregularity or illegality in the impugned order warranting interference of this Court.

Accordingly, the Criminal Revision Case is dismissed. However, since the order directing confiscation of the vehicle is appealable, the revision petitioner is at liberty to pursue the remedy available to him as per law, if so advised. In the event of filing an appeal, the period during which this matter was pending shall be excluded for the purpose of computation of limitation.
