THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 5790 of 2016 ORDER:
Heard Sri N.V.Sumanth, learned counsel representing M/s.Indus Law Firm, learned counsel for the petitioner, and Sri P.Kesava Rao, learned Standing Counsel for respondent Nos.2 and 3.
2. The impugned final notice dated 30.01.2016 does not indicate any opportunity having been given to the petitioner prior to the quantification of the amount due and payable by it. On the other hand, the impugned final notice merely calls upon the petitioner to make the subject payment within the stipulated time.
3. Sri N.V.Sumanth, learned counsel, submits that the petitioner has already submitted its representation dated 12.02.2016 raising certain issues with regard to the quantification of the amount payable under the impugned final notice.
4. In that view of the matter, the impugned final notice dated 30.01.2016 shall be treated as a show cause notice and the Greater Hyderabad Municipal Corporation shall consider the petitioner's representation dated 12.02.2016 as a response thereto. The Greater Hyderabad Municipal Corporation shall take into account the issues raised by the petitioner under the afore-stated representation and thereafter pass final orders with regard to the quantification of the amount due and payable by the petitioner. This exercise shall be completed expeditiously.
The Writ Petition is accordingly disposed of with the above directions. Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
