HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO. 2869 OF 2015 ORDER:

At the admission stage, the following order is passed. A perusal of the FIR and charge sheet would show a prima facie accusation against petitioner/accused to the effect that she beat the complainant five times with her footwear for which the complaint was lodged and after investigation charge sheet was laid. As the matter stands as such, it is not a fit case to quash the proceedings.

Learned counsel tried to bring to the notice of this Court regarding the difference of time of offence noted in FIR and in the medical report and also other points which in the considered view of this Court, may serve as defence in the trial.

Therefore, the petitioner is directed to face the trial and put forth all the defences that are legally permissible to her under law for consideration of that Court. Then considering the request of learned counsel for petitioner that the petitioner/accused is a lady and her appearance in Court for every adjournment will cause hardship to her, her attendance in CC No. 2163 of 2014 on the file of learned III Additional Chief Metropolitan Magistrate at Nampally, Hyderabad, is dispensed with except on the occasions when the trial court requires her attendance.

Accordingly, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
